Sales and Service Agreement

There are plenty of on-line resources you can use to develop your contracts and agreements, especially your photo licensing agreements. Every business will have different needs, but at the least, explore and write out terms and conditions for your clients to engage you professionally. Those T&As can be transmitted as you see fit. For what I do, I have mine as part of agreeing to my FAQs and have them book through my website (www.kpcvisualservices.com).

@Jason Henderson Thanks for sharing your terms and conditions agreement.  I just saw one thing that was confusing.  In the first paragraph you are granting a "a non-exclusive, perpetual fully transferable, sublicensable worldwide right and license", but in paragraph 3E under restrictions you say "No Sublicenses. Client will not sublicense the Work without the prior written permission of Photographer.".

Don't those two statements contradict each other?

Other than that it looks like a great example of a terms and conditions document.  It's not too complicated, but still gives you lots of protection in the event there is a conflict with the client.

Does anyone else have examples they are willing to share?  What do you think are the most important elements to include in a contract?

For the client, I am granting them full use worldwide for the images I do for them, but that client work used for anyone else (especially that includes monetary compensation) will require my permission.

I haven’t revisited that T&C since I put it up (COVID+family), so coming into 2021 before I engage a client should warrant a review considering your comment. Thank you!

No problem.  Happy to help.  I'm thinking about building a mini-course that just covers the components of a good terms and conditions contract so I've been researching it a lot lately.  I've been a freelance photographer for many many years and am familiar with rights and licensing, but want to learn more about what drone-specific clauses should be included.  Good luck with the business in the new year!
